On 23 May 2023, Judge Maksym Khodakivskyi of the Zhovtnevyi District Court of Dnipro held a webinar on "Peculiarities of consideration of civil cases on deprivation of parental rights" for Master's degree students of the NAU Law Faculty.

The judge noted that the law clearly establishes the procedure for deprivation of parental rights. In Ukraine, such a process takes place only in court. According to court practice, the most common grounds for deprivation of parental rights is evasion of parental responsibilities. Deprivation of parental rights is considered an extreme measure, however, in exceptional cases, if the guilty behaviour of one or both parents is proved, taking into account its nature, the identity of the father and mother, as well as other specific circumstances of the case, the court may dismiss the claim for deprivation of these rights, warning the defendant of the need to change his attitude to the upbringing of the child (children) and entrusting the guardianship and custody authorities with control over the performance of parental duties. Thus, the deprivation of parental rights is allowed only when it is impossible to change the parents' behaviour for the better, and only if the parents are guilty of the actions.

During the event, Maksym Khodakivskyi shared with the students his practical experience in handling these cases. "One of the main factors in the work of a judge is an individual approach to each case using the principle of the judge's inner conviction. It is this principle that is crucial in the work of the judiciary," the judge said.
